These terms of use by Bluco (hereinafter "Bluco") apply to the use of offers, applications, and services by Bluco (hereinafter "Services") by users (hereinafter "Users"), such as:
By using the Services, the User accepts these terms of use in their current version.
General Terms and Conditions accepted by the User in another context (e.g., when purchasing products or services) from Bluco are reserved.
The use of third-party services integrated into or linked from the Bluco Services ("Third-Party Services") is exclusively subject to the terms of use of these third parties (see section 3).
Bluco may change, expand, or discontinue the Services at any time.
Product descriptions, offers, prices, and other information published by Bluco on the Services may be changed at any time by Bluco and are not binding without an express separate agreement between Bluco and the User.
Bluco may make certain Services subject to charges.
Bluco makes reasonable efforts to use current and correct data in its Services, although data may contain errors or incomplete information for technical or other reasons. The User has no claims against Bluco arising from these data.
Bluco strives to ensure adequate availability of the offered Services but does not guarantee uninterrupted or disturbance-free operation of the Services. Bluco endeavors to correct technical disturbances within its control within a reasonable period.
The User has no claim to the use of the Services or Third-Party Services.
Registration or the creation of a user account may be necessary to use the Services. Registration or opening of a user account is permitted only to capable users (natural and legal persons). The User is obligated to provide complete and accurate information and to make immediate updates if the information is no longer current. The User is responsible for the content of his registration and the information he provides about himself. Bluco is not obligated to verify the accuracy or completeness of the User's information.
Login to the user account is done with the access data created during registration (such as username/password) or via a third-party platform or an identity provider chosen by the User. Bluco may consider any access with the correct access data (username/password) or authenticated by an identity provider as authorised access. Bluco is free to refuse a registration for valid reasons, to delete a user account, or to restrict access to it.
Bluco determines the type of access protection and takes appropriate measures to protect its Services against unauthorised access by third parties.
The User is obligated to keep his access data confidential and to protect it against misuse. No claims can be made by the User against Bluco in case of misuse of the access data or damages resulting from unauthorised access to the user account and use of the Services. If the User notices or suspects misuse, he must immediately inform Bluco by email at support@bluco.ai.
The user account or rights thereto may not be transferred or assigned by the User.
Bluco may integrate or link third-party services into its Services. For example, individual functions of the Services may provide for interactions between the User and Third-Party Services.
It is the sole responsibility of the User how he interacts with such Third-Party Services. Bluco has no influence on the design of these Third-Party Services and their content. The User has no claims against Bluco arising from the use of these Third-Party Services.
The use of Third-Party Services is exclusively subject to the terms of use and privacy policies of these third parties.
The User commits to using the Services for their intended purpose and to refrain from any inappropriate, abusive, and unlawful use, such as introducing malware (such as viruses, worms, or other spyware). Furthermore, the Services must not be used in a way that negatively affects their availability (for example, through the use of automatic devices, scripts, and robot, spider, crawler, or scraper services).
The User acknowledges that the contents published on the Services are legally protected and that their use requires the consent of the respective rights holder.
The complete or partial reproduction, transmission (electronically or by other means), or modification of the Services or contents is not allowed.
Copying, downloading, or printing of contents is only permitted for personal, non-commercial use, provided that any copyright notices or other protected designations are not removed.
Bluco is a registered trademark of Bluco. The User has no right to use this trademark or future additional trademarks of Bluco. The same applies to trade names, product and service designations, and logos not registered in the trademark register.
Any liability of Bluco in connection with the use of the Services and Third-Party Services is excluded.
The User agrees to indemnify Bluco from any claims by third parties resulting from the User's violation of these terms of use.
In case of violation of these terms of use by the User, Bluco is entitled to deny or restrict the User's access to the Services.
The data protection declaration of Bluco in its current version applies, available at Bluco Privacy Policy.
Bluco may send registered Users information about other products or services of Bluco (for example, in the form of a newsletter or by letter). If the User no longer wishes to receive such communications, he can unsubscribe at any time by email at unsubscribe@bluco.ai.
Bluco may change these terms of use at any time. The current version at the time of use applies, available at Terms of Use of Bluco.
Should one or more provisions of these terms of use be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
These terms of use are subject to French law, excluding the rules of international private law.
The exclusive jurisdiction for all disputes arising from or in connection with these terms of use is the location of Bluco (Paris).
